2. Content
Every effort is made to ensure the products on this site are displayed as accurately as possible but there may be some variation in colour between the website photographs and the actual product.
3. Ordering
3.1 To place an order select an item and follow the instructions. This creates an offer to us, from you, to purchase the product you have selected.
3.2 Your debit or credit card will be charged for the whole amount of your order when the order is created.
3.3 We will arrange delivery once your payment has been authorised and the availability of the product has been checked. If there is a delay on delivery we will inform you as soon as reasonably practicable.
3.4 When we accept your order we will send you an e-mail confirming the order and, if appropriate, details of how your goods will be delivered. At this point there will be a legally binding contract between us.
3.5 Please note we reserve the right to decline all or any part of your order for any reason whatsoever. Should this occur we will e-mail you confirming your order, or part of it, has been declined.
3.6 Please keep all e-mails you receive from us relating to your order. Please contact us if you want information regarding your order.
4. Payment
Your debit or credit card is charged for the whole of the amount of your order. Should there be insufficient stock to satisfy your order a refund will be processed through the debit or credit card used for the payment of the order and you will be notified by email as soon as possible. We will also notify you if your debit or credit payment cannot be authorised for any reason. All prices on the website are quoted in UK pounds.
5. Prices
The prices of Products purchased from this website are those displayed on the check out page of The Friendly Panda website. Should the product price be reduced after you have purchased the item we cannot refund the difference.

Debit and credit card payments on The Friendly Panda are protected by a secure connection
7. Delivery
Items will be delivered to the address you give us when you place your order. If there is a delay in the delivery due to circumstances beyond our control we cannot accept any liability for consequential loss. Provided we have received full payment for the goods, ownership of the goods (and liability for their loss and destruction) passes to you on delivery. Please make sure the goods can be delivered safely and easily.
8. Statutory Rights
8.1 Under the Distance Selling Regulations you are entitled to a cooling off period starting on the date you placed your order and ending seven days after you have received the goods.
8.2 If you want to cancel the contract you must inform us in writing (we will accept an e-mail) during the cooling off period mentioned in 8.1 above.
8.3 If the goods have not been delivered at the time you cancel the contract we will refund all the monies you have paid for the goods including any delivery charge and this will be refunded through the debit or credit card used for the payment of the order. This will be done as soon as possible but, in any event within 30 days of your cancellation being accepted.
8.4 If the goods are either en route or have been delivered at the time you have cancelled the contract they must be returned to us as soon as possible. You are the owner of the goods once they have been delivered and you will be liable for their loss or destruction. We will refund all the monies you have paid for the goods including the delivery charge but the cost of returning the goods rests with you. The refund will be through the debit or credit card used for the payment of the order and this will be done as soon as possible and in any event within 30 days of your cancellation being accepted PROVIDED THAT the goods are returned by you and received by us in the same condition they were in when they were delivered to you.
9. Changes
We may make changes to the website on a temporary or permanent basis and without prior notice. We make no guarantee that any product you may have seen on a previous visit to this website will still be available on your next visit.
10. Privacy
The personal information you provide us is used to operate our business and fulfil your orders and to provide you with information about our products. It is also used to improve our services. By supplying your e-mail address you authorise us to keep in touch with you to process your order and to keep you informed of promotions or new products to our website. If you do not wish to receive these marketing emails please send an email to us at admin@thefriendlypanda.co.uk and we will make sure that you do not receive promotional emails.
Your e-mail address or telephone number will not be passed on to a third party.

You agree that the content of this website is the property of The Friendly Panda.You acknowledge and agree that all copyright , trademarks, design rights and all other intellectual property in all contents of this website shall remain vested in The Friendly Panda at all times and unless authorised by us in writing you will not copy, reproduce, change, modify, license, transmit, publish, display, distribute, sell any material or content of this website.
12. Capacity
To enter into a contract for the purchase of goods from this website you must provide to us such information as we require to process your order. This can include your name, a telephone number, your debit or credit card details and an address for the delivery of your purchase.
13. General
13.1 We are not liable for delay or failure to perform any part of the contract if the delay or failure is for a reason beyond our reasonable control.
13.2 If it is found by a competent court that any part of these Terms and Conditions is unenforceable the remaining Terms and Conditions shall remain in full force and effect.
13.3 Failure on our part to take action for a breach of these Terms and Conditions is not a waiver of our right to take such action at a later date.
14. Jurisdiction and Agreement
14.1 You and The Friendly Panda agree that these Terms and Conditions shall be construed in accordance with English law and to submit to the exclusive jurisdiction of the English courts.
14.2 These Terms and Conditions together with the prices on the website, delivery prices, our Privacy Policy and the information you supply with your order constitutes the entire agreement between you and us. No representation made by an employee of The Friendly Panda will form part of the agreement between us unless it has been confirmed by us in writing.
